These Terms and Conditions (“Terms”, “Agreement”) govern your access to and use of the Bamrofem Homes website, platform, property listings, user accounts, agent and agency services, communications, and other services made available through https://bamrofemhomes.com/ (collectively, the “Platform”).

By accessing, browsing, registering on, or using the Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

If you do not agree to these Terms, you must not use the Platform.

1. ABOUT BAMROFEM HOMES

Bamrofem Homes is a real estate platform providing property-related information and services, including, where applicable:

  • Property listings;
  • Property marketing;
  • Property searches;
  • Property enquiries;
  • Connections between property seekers and property owners, agents, agencies, developers, landlords, sellers, or other property professionals;
  • Agent and agency profiles;
  • Real estate-related communications and services; and
  • Other services introduced by Bamrofem Homes from time to time.

The specific services available to you may depend on your location, account type, and the services offered on the Platform.

2. ACCEPTANCE OF THESE TERMS

By using the Platform, you confirm that:

  1. You have legal capacity to enter into this Agreement;
  2. The information you provide to Bamrofem Homes is truthful and accurate;
  3. You will comply with applicable laws and regulations;
  4. You will not use the Platform for unlawful, fraudulent, abusive, or deceptive purposes; and
  5. You accept these Terms and any additional terms applicable to particular services.

If you are using the Platform on behalf of a company, agency, business, or other legal entity, you represent that you have authority to bind that entity to these Terms.

3. ELIGIBILITY

You must be legally capable of entering into a binding agreement to use the Platform.

Where applicable law establishes a minimum age for particular services, you must satisfy that requirement.

Bamrofem Homes may restrict access to particular features where age, identity, location, professional status, or other verification requirements apply.

4. USER ACCOUNTS

Certain features may require registration.

When creating an account, you agree to provide information that is accurate, complete, current, and not misleading.

You are responsible for:

  • Maintaining the confidentiality of your password;
  • Protecting your account credentials;
  • Keeping your account information accurate;
  • Preventing unauthorized use of your account; and
  • Notifying Bamrofem Homes promptly if you suspect unauthorized access.

You must not create an account using another person’s identity or information without authorization.

Bamrofem Homes reserves the right to suspend, restrict, or terminate accounts that violate these Terms or applicable law.

5. GOOGLE AND THIRD-PARTY LOGIN

Where Google Login or another third-party authentication service is available, authentication may be provided by the relevant third-party service.

Your use of such services may also be subject to the third party’s terms and privacy policies.

Bamrofem Homes does not control third-party authentication services and cannot guarantee their continuous availability.

6. AGENT AND AGENCY REGISTRATION

Users may be permitted to register as agents or agencies.

By registering as an agent or agency, you represent and warrant that:

  • The information provided is accurate;
  • You have authority to represent the properties you advertise;
  • You will not advertise properties without appropriate authorization;
  • Your contact information is accurate;
  • Your listings will not contain intentionally misleading information;
  • You will comply with applicable real estate, consumer protection, advertising, privacy, and other laws; and
  • You will promptly correct inaccurate or outdated information.

Bamrofem Homes may verify, review, suspend, remove, or decline agent or agency profiles where necessary.

Registration as an agent does not constitute employment, partnership, franchise, joint venture, or agency between the agent and Bamrofem Homes unless expressly agreed in writing.

7. PROPERTY LISTINGS

Property listings may contain information including:

  • Property descriptions;
  • Photographs and videos;
  • Prices;
  • Locations;
  • Property features;
  • Availability;
  • Floor areas;
  • Ownership or tenancy information;
  • Agent or agency information; and
  • Other information supplied by users, property owners, agents, agencies, developers, or third parties.

Bamrofem Homes makes reasonable efforts to maintain accurate information but does not guarantee that every listing is accurate, complete, current, available, or error-free.

Property prices, availability, specifications, descriptions, photographs, and other information may change without notice.

Users should independently verify material information before entering into a transaction.

8. NO GUARANTEE OF PROPERTY AVAILABILITY

A property appearing on the Platform does not guarantee that the property remains available.

A listing may have been:

  • Sold;
  • Let;
  • Withdrawn;
  • Reserved;
  • Relisted;
  • Subject to an offer; or
  • Changed by the property owner, agent, agency, or other responsible party.

Bamrofem Homes shall not be responsible for changes made by third-party listing providers.

9. PROPERTY TRANSACTIONS

Bamrofem Homes may facilitate communication between property seekers and property owners, agents, agencies, landlords, sellers, developers, or other third parties.

Unless expressly stated otherwise, Bamrofem Homes is not itself a party to a property transaction between users and third parties.

A website enquiry does not constitute:

  • An offer;
  • Acceptance;
  • A sale;
  • A purchase;
  • A lease;
  • A tenancy agreement;
  • A reservation;
  • A transfer of ownership; or
  • Any other legally binding property transaction.

Any property transaction should be documented through an appropriate legally enforceable agreement between the relevant parties.

10. USER DUE DILIGENCE

You are responsible for conducting appropriate due diligence before entering into any property transaction.

This may include verifying:

  • Property ownership;
  • Title and registration;
  • Planning and zoning status;
  • Property boundaries;
  • Building approvals;
  • Rates and taxes;
  • Outstanding liabilities;
  • Agent or intermediary authority;
  • Identity of the counterparty;
  • Property condition;
  • Rental or sale terms; and
  • Any other matter relevant to the transaction.

Bamrofem Homes does not replace the need for independent legal, financial, property, valuation, surveying, or other professional advice.

11. PAYMENTS AND FINANCIAL TRANSACTIONS

Where payments are facilitated through the Platform, applicable payment terms will be communicated before the transaction.

Users must provide accurate payment information and must not use fraudulent payment methods.

Unless expressly stated otherwise, payment to or through the Platform does not automatically constitute transfer of property ownership, creation of a tenancy, or confirmation of a property transaction.

Bamrofem Homes will not be responsible for payments made to persons or accounts that are not officially designated by Bamrofem Homes.

Users should verify payment instructions before transferring funds.

12. USER-GENERATED CONTENT

Where users may submit property listings, photographs, videos, descriptions, reviews, comments, or other content (“User Content”), you remain responsible for the content you submit.

You represent and warrant that:

  1. You own or have permission to use the content;
  2. The content is accurate and not intentionally misleading;
  3. The content does not infringe another person’s rights;
  4. The content does not violate applicable law;
  5. The content does not contain malicious software; and
  6. The content does not contain unlawful, fraudulent, defamatory, discriminatory, or abusive material.

You grant Bamrofem Homes a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, distribute, format, adapt, and use User Content as reasonably necessary to operate, promote, and improve the Platform.

You retain ownership of your intellectual property rights in User Content, subject to the licence granted above.

13. PROHIBITED PROPERTY LISTINGS

You must not submit or publish listings that:

  • You do not have authority to advertise;
  • Contain materially false information;
  • Misrepresent ownership;
  • Use another person’s identity without authorization;
  • Contain fraudulent pricing or transaction information;
  • Promote illegal activities;
  • Infringe intellectual property rights;
  • Contain discriminatory or unlawful restrictions;
  • Contain malicious links or software; or
  • Otherwise violate applicable law.

Bamrofem Homes may remove or restrict any listing that it reasonably believes violates these Terms or applicable law.

14. INTELLECTUAL PROPERTY

Unless otherwise stated, Bamrofem Homes and its licensors own or control the intellectual property associated with the Platform, including:

  • Logos;
  • Brand names;
  • Website design;
  • Text;
  • Graphics;
  • Software;
  • Interface elements;
  • Original photographs;
  • Marketing materials; and
  • Other proprietary materials.

You may not reproduce, distribute, modify, sell, publish, reverse engineer, or commercially exploit Bamrofem Homes intellectual property without prior written authorization, except where permitted by applicable law.

Third-party trademarks, photographs, logos, and property materials remain the property of their respective owners.

15. PRIVACY AND PERSONAL INFORMATION

Bamrofem Homes may collect and process personal information when you use the Platform.

This may include information provided when you:

  • Create an account;
  • Register as an agent or agency;
  • Submit a property;
  • Submit an enquiry;
  • Contact us;
  • Use Google or another social login;
  • Subscribe to communications; or
  • Otherwise interact with the Platform.

Personal information will be handled in accordance with our Privacy Policy and applicable data-protection laws.

Where Bamrofem Homes processes personal information in South Africa, it intends to comply with the Protection of Personal Information Act 4 of 2013 (POPIA) and applicable regulations. POPIA establishes conditions for lawful processing of personal information by private and public bodies.

Where applicable, Bamrofem Homes will also respect mandatory data-protection rights applicable to users in other jurisdictions.

16. ELECTRONIC COMMUNICATIONS

By using the Platform or providing your contact details, you may receive electronic communications relating to:

  • Your account;
  • Property enquiries;
  • Transactions;
  • Security;
  • Service updates;
  • Administrative matters; and
  • Marketing communications where permitted by applicable law.

You may opt out of marketing communications where an applicable unsubscribe mechanism is provided.

Electronic communications and transactions may be governed by applicable electronic-commerce legislation, including South Africa’s Electronic Communications and Transactions Act 25 of 2002 (ECTA) where applicable.

17. CONSUMER PROTECTION

Bamrofem Homes intends to conduct its consumer-facing activities in accordance with applicable consumer-protection laws.

For South African users and transactions to which it applies, this includes the Consumer Protection Act 68 of 2008 (CPA), which establishes norms and standards for consumer protection and regulates unfair marketing and business practices.

Nothing in these Terms is intended to exclude, restrict, or waive a consumer right that cannot lawfully be excluded, restricted, or waived under applicable legislation.

18. INTERNATIONAL USERS

Bamrofem Homes may be accessed by users from different countries.

If you access or use the Platform from outside South Africa, you are responsible for complying with the laws applicable to you and your location.

Nothing in these Terms is intended to remove or limit mandatory rights that apply to you under the law of your jurisdiction where those rights cannot legally be excluded.

Where local law provides consumers with mandatory protections, those protections remain applicable to the extent required by law.

19. THIRD-PARTY SERVICES

The Platform may integrate with or contain links to third-party services, including:

  • Google;
  • Payment providers;
  • Mapping services;
  • Hosting providers;
  • Analytics services;
  • Social media platforms;
  • Communication services; and
  • Other external services.

Third-party services are governed by their own terms and policies.

Bamrofem Homes is not responsible for the acts, omissions, availability, security, content, or policies of independent third parties.

20. WEBSITE SECURITY

We take reasonable measures to protect the Platform.

However, no internet-based system can be guaranteed to be completely secure.

You acknowledge that transmission of information over the internet carries inherent risks.

You must not attempt to:

  • Gain unauthorized access;
  • Circumvent security controls;
  • Introduce malicious code;
  • Interfere with Platform operations;
  • Conduct denial-of-service attacks;
  • Scrape the Platform in violation of applicable restrictions; or
  • Access another user’s account without authorization.

21. AVAILABILITY OF THE PLATFORM

Bamrofem Homes does not guarantee that the Platform will always be available, uninterrupted, secure, or error-free.

We may temporarily suspend services for:

  • Maintenance;
  • Security;
  • Upgrades;
  • Technical problems;
  • Emergency situations;
  • Third-party service interruptions; or
  • Other operational reasons.

22. DISCLAIMERS

To the maximum extent permitted by applicable law, Bamrofem Homes does not guarantee:

  • The accuracy of every property listing;
  • The availability of a listed property;
  • The accuracy of third-party information;
  • The completion of any transaction;
  • The conduct of another user;
  • The financial or legal status of a property;
  • The suitability of a property for a particular purpose; or
  • That the Platform will be uninterrupted or error-free.

Information provided through the Platform should not be treated as legal, financial, investment, valuation, surveying, tax, or professional advice.

23. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Bamrofem Homes shall not be liable for indirect, incidental, consequential, special, or unforeseeable losses arising from your use of the Platform.

This may include losses arising from:

  • Third-party property listings;
  • Transactions between users;
  • Fraud committed by third parties;
  • Incorrect information supplied by users;
  • Property availability changes;
  • Unauthorized transactions;
  • Third-party services;
  • Website interruptions; or
  • Loss of information caused by circumstances beyond our reasonable control.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

24. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Bamrofem Homes, its owners, directors, officers, employees, contractors, representatives, and service providers against claims, losses, liabilities, damages, costs, and expenses arising from:

  • Your breach of these Terms;
  • Your unlawful use of the Platform;
  • Your User Content;
  • Your violation of another person’s rights;
  • Fraudulent or misleading information you provide;
  • Your violation of applicable law; or
  • Your dealings with other Platform users.

25. SUSPENSION AND TERMINATION

Bamrofem Homes may suspend or terminate your account or access to the Platform where reasonably necessary, including where:

  • You breach these Terms;
  • You provide fraudulent information;
  • You engage in unlawful conduct;
  • Your account presents a security risk;
  • You misuse the Platform;
  • You infringe another person’s rights; or
  • Continued access would expose Bamrofem Homes to legal or regulatory risk.

Where required by applicable law, appropriate notice or procedural rights will be provided.

Termination does not affect rights or obligations that accrued before termination.

26. CHANGES TO THESE TERMS

Bamrofem Homes may update these Terms from time to time.

Updated Terms will be published on this page together with an updated “Last Updated” date.

Where required by applicable law, material changes will be communicated through appropriate means.

Your continued use of the Platform after the effective date of updated Terms constitutes acceptance of the updated Terms to the extent permitted by law.

27. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable where legally permitted.

The remaining provisions shall continue in full force and effect.

28. NO WAIVER

Failure by Bamrofem Homes to enforce any provision of these Terms does not constitute a waiver of its right to enforce that provision later.

29. ENTIRE AGREEMENT

These Terms, together with any applicable service-specific terms, Privacy Policy, Cookie Policy, and other policies expressly incorporated into them, constitute the agreement between you and Bamrofem Homes regarding your use of the Platform.

Where a specific written agreement governs a particular transaction, that agreement will apply to that transaction to the extent of any inconsistency.

30. GOVERNING LAW AND JURISDICTION

These Terms shall be governed primarily by the laws of the Republic of South Africa, unless mandatory laws applicable to a particular user or transaction require otherwise.

Subject to mandatory consumer-protection, data-protection, and other applicable legal rights, the courts of South Africa shall have jurisdiction over disputes arising from these Terms or your use of the Platform.

Nothing in this clause prevents a consumer from exercising a mandatory right to bring proceedings in another jurisdiction where such right is provided by applicable law.

31. DISPUTE RESOLUTION

We encourage users to contact Bamrofem Homes first to attempt to resolve complaints or disputes informally.

Where appropriate and legally permissible, the parties may attempt:

  1. Good-faith negotiation;
  2. Mediation; or
  3. Another mutually agreed dispute-resolution process.

Nothing in this section prevents a party from exercising a statutory right or seeking urgent legal relief where permitted by law.

32. FORCE MAJEURE

Bamrofem Homes shall not be responsible for failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control.

Such circumstances may include:

  • Natural disasters;
  • Fire;
  • Flood;
  • Epidemics or pandemics;
  • War;
  • Terrorism;
  • Civil unrest;
  • Government action;
  • Power failures;
  • Internet or telecommunications failures;
  • Cybersecurity incidents;
  • Third-party infrastructure failures; or
  • Other events beyond reasonable control.

34. IMPORTANT LEGAL NOTICE

These Terms are intended to establish the contractual framework governing use of the Bamrofem Homes Platform.

Nothing in these Terms is intended to:

  • Exclude a statutory consumer right;
  • Override mandatory data-protection legislation;
  • Exclude liability that cannot legally be excluded;
  • Prevent a regulator or competent authority from exercising its legal powers; or
  • Prevent a user from exercising a mandatory legal right.

Where the laws of a user’s jurisdiction provide protections that cannot legally be waived, those protections will continue to apply.
